  1. General Welfare

Buyer agrees to provide the dog/puppy with a safe, loving, and responsible home, including appropriate shelter, quality nutrition, regular exercise, and routine veterinary care. Under no circumstances shall the dog/puppy be sold, surrendered, or transferred to a pet store, shelter, pound, rescue group, research facility, or any individual or entity involved in illegal or violent activity (e.g., dog fighting).

 

  1. Transfer of Ownership

Should the Buyer, for any reason, become unable to retain ownership of the dog/puppy, the Seller must be notified immediately. The dog/puppy must be returned to the Seller at the Buyer’s expense unless the Seller has provided prior written approval for the dog/puppy to be rehomed privately. Under no circumstances may the dog be surrendered to a rescue, shelter, or pound. 

Escalante English Labradors maintains a lifelong commitment to all dogs produced and will accept a return at any time, under any circumstances, without judgment or explanation.

 

  1. Release of Liability

Upon transfer of the dog/puppy to the Buyer, the Seller is released from any and all claims, liabilities, or damages resulting from the behavior, health, or actions of the dog/puppy, including injury or loss.

 

  1. Payment

The full purchase price is due before the dog/puppy is released to the Buyer. If a balance remains on the day of pickup, it must be paid in cash only. No dog/puppy will be released until payment has cleared.

 

  1. Registration and Naming

To preserve and identify the heritage of our breeding program, Buyer agrees that the dog’s AKC registered name shall begin with the prefix “Escalante” as the first word. This prefix is required for all dogs bred by Escalante English Labradors and is a condition of registration. The remainder of the registered name may be selected by the Buyer, subject to AKC guidelines.

  1. Virus Free Warranty

Dog/puppy is promised to be virus-free for 72 hours from the date of pick-up and to be of sound health and temperament at the time of sale to the best of Sellers knowledge. Seller does not guarantee against any communicable diseases beyond the 72 hours of buyer receiving the dog/puppy.

 

  1. Parasite Disclaimer

Dog/puppy has been dewormed at least twice before leaving Seller. However, recurring parasites (including but not limited to: giardia, coccidia, roundworms, tapeworms, hookworms, pinworms, fleas, and ticks) are a very common issue in young animals (especially in puppies), are easily treated, and are therefore not covered by this warranty.

 

  1. Veterinary Notes

Dog/puppy was examined by a licensed veterinarian before leaving Seller. Any notes or concerns mentioned by Seller’s veterinarian regarding dog/ puppy have been explained to Buyer and made note of in the space below:

 

 

 

 

  1. 72-Hour Veterinary Examination Requirement

The Buyer has 72 hours (excluding weekends and holidays) from the time of pick-up to have the dog/puppy examined by a licensed veterinarian. This initial exam documentation is required for the entirety of this health warranty to remain valid. The purpose of this examination is to confirm that the dog/puppy is free of serious illness or life-threatening genetic conditions.

 

 

If a life-threatening condition or serious illness is diagnosed during this exam, the Buyer must:

 

  1. Notify the Seller immediately, before any treatment or procedure is started.
  2. Provide written documentation of the diagnosis from the licensed veterinarian.

 

Acceptable documentation includes:

– Photocopies sent by postal mail 

– Clear, legible photos or PDF files of medical records sent via email or text

 

Once the Seller is notified and documentation is received, the Buyer must return the dog/puppy to the Seller within 48 hours, at the Buyer’s expense.

 

At that time, the Buyer will be entitled to one of the following, at their discretion:

– A replacement dog/puppy from the next available litter (may take up to one year), or 

– A full refund of the purchase price

 

Conditions Not Covered by Health Guarantee

This warranty excludes non-life-threatening, common, or trivial conditions, and those that cannot be tested for including but not limited to: undescended testicles, recessed vulva, umbilical hernia, entropion, ectropion, cherry eye, overbite, underbite, urinary tract infections, puppy strangles, temperament flaws or poor disposition. The Seller also makes no guarantee regarding the dog/puppy’s future suitability for any specific purpose, including but not limited to service work, therapy, or competitive activities.

 

  1. 5 Year Genetic Health Warranty

This warranty applies to the following conditions with appropriate proof:

 

Exercise-Induced Collapse (EIC)* – DNA test results required 

Centronuclear Myopathy (CNM)* – DNA test results required

Degenerative Myelopathy (DM)* – DNA test results required

Progressive Retinal Atrophy (PRA)* – DNA test or CERF exam results required 

‘Severe’ Hip Dysplasia – Veterinary X-ray & diagnosis & OFA evaluation required  

‘Grade 3’ Elbow Dysplasia – Veterinary X-ray & diagnosis & OFA evaluation required

Life-Threatening Heart Defects – Veterinary diagnosis and OFA evaluation required

Should the dog/puppy be diagnosed and documented by a licensed veterinarian or laboratory to have severe hip or elbow dysplasia, Life-threatening heart defects, or be afflicted with PRA, DM, EIC, or CNM within 5 years from Date of Birth a replacement dog/puppy of equal value will be offered from the Seller’s next litter with availability.

Preferences of Buyer will certainly be taken into consideration, depending on availability, but the choice of replacement puppy is ultimately at Seller’s discretion. It may take up to one year for a replacement puppy to become available.

No money will be refunded, and no monetary compensation will be given under any circumstances.

 

 

*If dog/puppy is determined to be a carrier of any of these diseases, it will never be affected by it, therefore, carriers are not covered by this warranty. Due to many factors beyond our control including but not limited to: poor nutrition, obesity, improper exercise, injury etc. we do not guarantee that your dog will pass their OFA finals, but we do warranty against severe hip dysplasia and grade 3 elbow dysplasia. 

 

Buyer may return ill dog/puppy to the Seller if desired, but is not required to do so.

 

This warranty does not include non-genetic defects resulting from things including, but not limited to obesity, neglect, malnutrition, injury, or excessive exercise and wear. This warranty is absolutely void if dog/puppy is spayed, neutered, or bred prior to 18 months of age.

  1. Breeding and Show Disclaimer

Puppy/dog is sold with limited AKC registration and as such is not eligible to produce AKC registered litters or compete in breed shows.

 

 

  1. Non-Transferability

This agreement is valid only for the Buyer named herein and is non-transferable.
